2 <br />The property owner, Nick Schwalbach, has applied to construct a 1,512 square foot <br />detached accessory building located in the rear yard of the property. The proposal includes <br />a finished and painted steel post-frame structure with a continuous foundation, allowing <br />for year-round indoor use. The proposed structure would have a height of 20 feet 4 inches <br />and a peak height of 22 feet 8 inches. According to the applicant, the building would be <br />used for indoor recreational activities by the household, including basketball, volleyball, <br />and pickleball. <br />The proposal requires approval of a Conditional Use Permit prior to issuance of building <br />permits for the following reasons: <br />•Detached accessory buildings are limited to 18 feet in height or the height of the <br />principal structure, whichever is less. The proposed structure exceeds this <br />limitation at 20 feet 4 inches. <br />•The combined area of all detached accessory buildings on a lot is limited to 1,500 <br />square feet. The proposed structure exceeds this limit at 1,512 square feet. <br />•Detached accessory buildings utilizing pole-type or post-frame construction require <br />specific approval through a Conditional Use Permit. <br />Conditional Use Permit Review Standards <br />1.The use is allowed as a Conditional Use in the zoning district and conforms to <br />standard zoning regulations; <br />The subject property is zoned R-1 Low Density Residential. The City Code allows <br />detached accessory structures to be reviewed as a Conditional Use Permit when <br />proposals exceed maximum area or height limitations, or when non-traditional <br />materials or post-frame construction methods are proposed. <br />The proposal, as submitted and reviewed, conforms to zoning standards that may not <br />be modified through a Conditional Use Permit, including: <br />•Setbacks <br />•Impervious Surface Coverage <br />•Rear Yard Coverage <br />Additional zoning and site compliance items are addressed in the Site Plan Review section <br />of this report. <br />2.The Conditional Use will conform to the conditions listed in Chapter 914 for the <br />proposed use; <br />a.The accessory building or structure shall meet or exceed all minimum setbacks <br />required for the zoning district and shall not cause the lot to exceed impervious <br />surface or yard coverage limits.
