<br /> <br />5 <br /> <br />result, the proposed accessory building will appear roughly the same height as the home, if not shorter, <br />when viewed from surrounding properties. Staff additionally do not believe that the proposed building <br />would be easily viewable from Vanderbie given its proposed placement in the rear yard and the height <br />of the home. <br /> <br />Staff defer to the Planning Commission’s finding, that the proposed structure is compatible with both <br />the home and the surrounding neighborhood. <br /> <br />RECOMMENDATION <br />The City Code expressly allows detached accessory structures to be considered through the <br />Conditional Use Permit process when proposals exceed by-right size or height limits or utilize post- <br />frame construction and non-traditional materials. Approval of this request is consistent with the <br />permissive structure of the Code and with recent amendments intended to allow greater flexibility in <br />accessory building design. <br /> <br />Approval is supported by findings that the proposal meets the applicable Conditional Use Permit <br />criteria when evaluated in the context of the site, the size of the lot, and the rear-yard placement of the <br />structure. Approval is also supported by recognizing that the surrounding neighborhood retains by- <br />right entitlements for future expansion or redevelopment, including principal structures that may be <br />taller than those that exist today. <br /> <br />Given these findings, the Planning Commission’s discussion of the proposal, and the Planning <br />Commission’s recommendation to the City Council, staff recommend the following motion: <br /> <br />Approve the Conditional Use Permit for a detached accessory building at 2912 Vanderbie Street, <br />Little Canada, Minnesota as supported by the findings of fact in staff’s report and subject to the <br />following conditions: <br />1. Development authorized by this Conditional Use Permit shall not commence until the applicant <br />has obtained all other approvals required by the City Code or any other applicable regulations. <br />Approval of this Conditional Use Permit does not constitute approval of any other required <br />permit, including a building permit. <br />2. Development authorized by this Conditional Use Permit shall be substantially consistent with <br />the plans, elevations, and materials submitted with the application. Any material deviation from <br />the approved plans shall require City review and approval and may require an amended or new <br />Conditional Use Permit. <br />3. This Conditional Use Permit shall apply only to the specific detached accessory building <br />approved under this application and shall not authorize the construction of any additional <br />structures on the property. <br />4. Prior to issuance of a building permit, the applicant shall submit a site plan prepared by a <br />licensed surveyor demonstrating compliance with minimum side and rear yard setbacks of five <br />feet and documenting all existing and proposed impervious surfaces on the property. Any <br />submittal demonstrating noncompliance with setback, impervious surface, or rear yard <br />coverage standards shall be rejected and may require amendment of the Conditional Use Permit <br />or revision of the proposal. <br /> <br />
