MINUTES <br />CITY COUNCIL <br />JULY 25, 2001 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Montour, LaValle, Scalze, Fahey, Anderson. <br />Nays (0). Resolution declared adopted. <br />PUD PERMIT — Fahey opened the continuation of Public Hearing to consider the <br />RICE /SPRUCE application for Planned Unit Development Permit allowing construction <br />STREETS — of an industrial /office complex in the Rice Street /Spruce Street area as <br />FRATTALONE requested by Frank Frattalone, Frattalone Excavating. Fahey noted that <br />EXCAVATING the Council held a workshop meeting just prior to tonight's regular meeting to <br />review the PUD permit request. <br />There was no one from the general public present wishing to comment on this <br />matter. <br />Upon motion by Fahey, seconded by Montour, the public hearing was closed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001 -7- 158— APPROVING A PLANNED UNIT <br />DEVELOPMENT PERMIT ALLOWING CONSTRUCTION OF AN <br />INDUSTRIAL/OFFICE COMPLEX AT THE RICE STREET/SPRUCE <br />STREET SITE AS REO_ UESTED 13Y FRATTALONE EXCAVATING <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF <br />THE CITY ENGINEER, CITY PLANNER, ,4ND THE WATERSHED <br />WITH THE FOLLOWING ADDITIONAL .STIPULATIONS AND /OR <br />CHANGES: <br />*REQUIRING DEDICATION OFA 30 -FOOT TRAIL EASEMENT <br />ALONG 13LACKTERN POND ON THE RICE STREET SITE; <br />*ALLOWING 2 TO I SLOPES IN THE AREAS OF CONCERN <br />NOTED /3Y THE CITY ENGINEER SUBJECT TO REVIEW AND <br />APPROVAL OF THE CITY ENGINEER FOR SLOPE STABILITY <br />GIVEN THIS AREA IS TO BE UNDISTURBED AREA WITH <br />NATIVE PLANTINGS; <br />*REQUIRING A BITUMINOUS ACCESS DRIVE THROUGH THE <br />RICE STREET SITE; <br />*ALLOWING THE ACCESS DRIVE FROM THE RICE STREET <br />SITE TO THE SPRUCE STREET SITE TO I3E SURFACED WITH <br />MILLED ASPHALT WITH THE STIPULATION THAT THE CITY <br />COUNCIL MAY REQUIRE BITUMINOUS PAVING IN THE <br />EVENT THERE ARE LSSUES WITH DUST CONTROL, <br />TRACKING OF DIRT, A CHANGE IN OWNERSHIP OF THE <br />PROPERTY, OR OTHER CONCERNS AS DEEMED <br />APPROPRIATE 131' THE CITY COUNCIL <br />4 <br />
