MINUTES <br />PLANNING COMMISSION <br />MAY 10, 2001 <br />Motion seconded by Barraclough. <br />Motion carried 6 — 0. <br />CUP FOR Mr. Jim Cossack, 421 Eli Road, appeared before the Commission <br />OVERSIZED requesting approval of a Conditional Use Permit to allow construction <br />GARAGE — of a 36 -foot by 32 foot garage which is larger than the 1,000 square <br />421 ELI ROAD — foot maximum garage allowed as a permitted use. Cossack pointed out <br />JIM COSSACK that he does not currently have a garage. He also noted that the garage <br />would be used for storage of personal and recreational vehicles and would <br />not be used for business use. <br />Keis asked about the size of Cossack's house. Cossack noted that his <br />house is approximately 1,000 square feet in size. The garage he is <br />proposing to building is 1,152 square feet. Cossack indicated that he plans <br />to add onto the house in a year or two. <br />Duray asked about the exterior finish for the garage. Cossack replied that <br />the garage would be stucco to match the house. <br />Lorraine Pelton, Eli .Road resident, asked for a definition of Conditional <br />Use Permit. <br />The City Planner indicated that the City's Code allows a garage up to <br />1,000 square feet in size as a permitted use. Garages that are between <br />1,000 and 1,500 square feet in size require a Conditional Use Permit. This <br />permit requires review by both the Planning Commission and the City <br />Council to determine whether or not the garage fits the site and the <br />neighborhood and to ensure that there is no business use of the garage. <br />Pelton pointed out that the garage is a large building and the area is <br />primarily residential in nature. Pelton noted that the property owners in <br />this area want to keep it residential. Pelton informed the Commission that <br />at one time she requested a 5 -foot variance to subdivide her property so <br />that her son could build a single - family home. That variance request was <br />denied because the Council felt the variance would spoil the appearance of <br />the neighborhood. Pelton pointed out that now Mr. Cossack would like to <br />build a garage in the neighborhood that is larger than some houses. She <br />also noted that at one time Cossack had lithos parked on his property for <br />most of one winter. <br />Cossack indicated that he did park some limos in his yard for a short <br />period, but moved them into a warehouse in December of 1999. Cossack <br />again indicated that he will not use this garage for business purposes, but <br />Page 14 <br />
