MINUTES <br />City Council <br />June 25, 1986 <br />Thoe <br />Variance <br />(Cont.) <br />Barrett <br />Property <br />Division <br />Agenda <br />Item No. 7 <br />BASED ON THE RECOMMENDATION OF THE <br />PLANNING COMMISSION AND THE RECOMMENDATION <br />OF THE CITY PLANNER AND DUE TO THE LACK OF A <br />HARDSHIP <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (4) Nardini, Fahey, Scalze, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 15, Page 261. <br />Mr. Fahey pointed out the recommendation of the Planning <br />Commission with regard to the Barrett property division request. <br />Mr. Barrett is requesting approval of the division of his property <br />located at LaBore Road and County Road D into two lots. Barrett <br />stated that he was willing to comply with the recommendations <br />of the Planner and Planning Commission for removal of the existing <br />concrete garage. <br />Mrs. Scalze asked if there was adequate room between the existing <br />house and lot line to construct a garage without a variance. <br />The Planner pointed out that there is adequate room for a garage <br />as there are 45 feet between the lot line and existing house. <br />Scalze pointed out that the Engineer will have to review the <br />proposal and make a recommendation on drainage and utility easements. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 86 -6 -261 - APPROVING THE <br />BARRETT PROPERTY DIVISION AS REQUESTED <br />SUBJECT TO THE CONDITION THAT NO VARIANCE WILL <br />BE GRANTED FOR A GARAGE FOR THE EXISTING HOUSE <br />AND SUBJECT TO THE CONCRETE GARAGE ON LOT A <br />BEING ALLOWED TO REMAIN FOR A PERIOD OF SIX <br />MONTHS OR UNTIL AN OCCUPANCY PERMIT IS ISSUED <br />FOR A NEW HOME ON LOT A, WHICHEVER IS SOONER, <br />BASED ON THE APPLICANT'S COMPLIANCE 'WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AND THE <br />RECOMMENDATIONS OF THE CITY ENGINEER IN SO <br />FAR AS DRAINAGE AND UTILITY EASEMENTS ARE <br />CONCERNED <br />The foregoing resolution was duly seconded by Ms. Nardini. <br />Ayes (4) Scalze, Nardini, Collova, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 15, Page 262. <br />Page 53 <br />
