MINUTES
PLANNING COMMISSION
MAY 10, 2001
for that portion of the garage facing the neighbor's property might be a
good solution.
There was discussion about increased run -off from the roof. The Planner
noted that the property owner is required to provide for drainage, and
drainage cannot have an impact their neighbor's property.
Keis asked about the existing slab on the Abraham property. Mrs.
Abraham replied that the existing slab would be removed and replaced
with a new one for the garage.
Duray stated that he did not feel the criteria for a hardship was met and
was concerned about the precedent that would be set. Duray suggested
that a one -car garage be constructed.
The City Planner pointed out that one criteria for a hardship is whether the
property can be put to a reasonable use. The Planner indicated that the
issue the Commission is struggling with is whether a two -car garage is a
reasonable use or whether a one -car garage is a reasonable use. The
Planner indicated that the City has a lot of latitude in defining what a
reasonable use is for the community.
Carson felt that the entire neighborhood would be more valuable if the
homes had two car garages.
Roycraft recommended approval of the Variance from the Zoning Code
requirement of 10 foot minimum side yard setback allowing a new garage
with a 5 foot side yard setback at 2535 Stark Street as requested by
Tsgeroman Abraham subject to the overhang for the roof being minimized
and a hip roof being installed on the side of the garage facing the
neighbors, and based on the fact that there is a mix of setbacks in this
neighborhood which results in a 5 foot setback not being out of character
in this neighborhood, that the garage to be constructed is 19 feet, 6 inches
wide which is the smallest dimension possible for a standard two car
garage, based on the fact that prior to the Code being changed in 1979 5
foot setbacks were allowed.
Motion seconded by Wojcik.
Motion carried 4 to 2. Duray and Keis voted against.
ADJOURN Carson recommended that the meeting be adjourned.
Motion seconded by Barraclough.
Page 57
