MINUTES <br />CITY COUNCIL <br />NOVEMBER 8, 2000 <br />that he would be operating the rental hall on Friday and Saturday <br />evenings, and did not anticipate having the hall rented every Friday and <br />Saturday. <br />Morelan pointed out that bars are typically open from 9 a.m. until 1 a.m., 7 <br />days per week. Given that the banquet hall would be open considerably <br />less time, a lesser fee should be considered. <br />LaValle pointed out the $900 liquor license fees paid by My Le Ho that <br />staff used as a comparison, noting that My Le Ho is not required to have <br />an off -duty police officer on site during banquets. <br />Conroy reported that the previous operator of the rental hall informed him <br />that the hall was typically rented for 50 events each year. <br />Adamson indicated that a $900 fee may be reasonable, but requested that <br />the fee be less than that for the first year while he is establishing his <br />business. <br />The City Attorney explained the State Statute that establishes a Caterer's <br />Permit that can be issued to holders of On -Sale Liquor Licenses who also <br />operate restaurants. <br />It was noted that the Council has the authority to regulate this business <br />under the Conditional Use Permit rather than establish a separate liquor <br />license which addresses caterers as outlined in the City Attorney's letter <br />dated November 1, 2000. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Morelan, seconded by LaValle, the public hearing was <br />closed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-11-264 — APPROVING A CONDITIONAL <br />USE PERMIT ALLOWING A COMMERCIAL RECREATION USE <br />SERVING ALCOHOLIC BEVERAGES AT 433 LITTLE CANADA <br />ROAD AS REQUESTED BY K & J CATERING SUBJECT TO THE <br />FOLLOWING: <br />*COMPLIANCE WITH THE RECOMMENDATIONS OF THE <br />PLANNING COMMISSION; <br />Page 7 <br />
