MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 15, 2001 <br />parcel of land for the Highway 36 right -of -way. Mr. Kimmes reported <br />that he is confident that this situation can be resolved within the next few <br />months. <br />Keis asked what has changed that makes Mr. Kimmes feel the matter can <br />be resolved. <br />Kimmes indicated that his surveyor had somewhat dropped the ball on this <br />issue and the plat spent some time sitting on someone's desk. Kimmes <br />reported that he is anxious to begin development this spring, and he has an <br />attorney, his surveyor, and the County working on resolving the issue. <br />Kimmes pointed out that no changes have been made to the plat from what <br />was approved previously. <br />Duray asked if the plat should be re- approved conditioned upon resolution <br />of the title issue. The City Planner indicated that such a condition would <br />not need to be placed on approval since this is an issue that will need to be <br />resolved at the County level prior to recording of the plat. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Knudsen recommended approval of the Preliminary and Final Plat for <br />Gilanderi Addition as well as approval of a Variance allowing a cul -de -sac <br />length in excess of 500 feet subject to compliance with all previous <br />conditions placed on the original approval. <br />Motion seconded by Carson. <br />Motion carried 7 — 0. <br />PROPERTY Mr. Tom Theis, 3036 Leeward Way, appeared before the Commission <br />DIVISION & requesting approval of the division of 3021 Arcade Street into three lots <br />VARIANCE — as well as a Variance from the City's restriction on cul -de -sac length. <br />3021 ARCADE Theis pointed out that he is proposing to extend the Leeward Way cul -de- <br />STREET — sac by 87 feet to provide street access for the two new lots. Theis noted <br />TOM THEIS that eventually Leeward Way will continue south with a connection <br />provided to Allen Avenue. <br />Theis reported that currently Leeward Way dead -ends without a cul -de -sac <br />at the end, and he is proposing the same for the 87 -foot extension of the <br />street. Theis felt it was impractical to put a cul -de -sac at the end of <br />Leeward Way at this point given the potential for the street to be extended <br />in the future, and given that the area that would be required for a cul -de- <br />Page 11 <br />
