Ate <br />702.110. SUSPENSION AND REVOCATION. The Council shall either <br />suspend for up to 60 days or revoke any 3.2 percent malt liquor <br />license, or impose a civil fine not to exceed $2,000.00, for each <br />violation upon a finding that the licensee has failed to comply <br />with any applicable statute, regulation, or ordinance relating to <br />alcoholic beverages. Except in cases of failure of financial <br />responsibility, no suspension or revocation shall take effect until <br />the licensee has been afforded an opportunity for a hearing. The <br />lapse of required dram shop insurance or bond, or withdrawal of a <br />required deposit of cash or security, shall effect an immediate <br />suspension of any license issued pursuant to this ordinance without <br />further action of the City Council. Notice of cancellation, lapse <br />of a current liquor liability policy or bond, or withdrawal of <br />deposited cash or securities shall constitute notice to a licensee <br />of the impending suspension of the license. Any suspension under <br />this chapter shall continue until the City Council determines that <br />the financial responsibility requirements of this chapter have met. <br />702.120. GAMBLING DEVICES PROHIBITED. It shall be unlawful <br />for any person duly licensed to sell intoxicating malt liquor to <br />keep, possess or operate or permit the keeping, possession or <br />operation of, on any licensed premises, any slot machine, dice, <br />black jack table, or any gambling device or apparatus, whether or <br />not said devices are being used in violation of M.S. 609.755 or <br />609.76. A black jack table which is not being used in violation of <br />M.S. 609.755 or 609.76 shall be exempt from this prohibition. It <br />shall be unlawful for any licensee to permit any gambling on <br />licensed premises. This Section shall not preclude lawful gambling <br />pursuant to M.S. 349 nor shall it preclude the possession of <br />properly licensed and registered gambling equipment as defined in <br />M.S. 349.12, Subd. 15. <br />(Source: Ord. 1, Amended: Ord. 114, 236, 302, 330, 345, 348, <br />361, 364, 435) <br />Page 14 <br />
