Badka
Sweeney, Borer & Sweeney
' Professional Associa:ton
Attorneys at Law
• Sulte 1200 .
386 North Wabasha Street
:St. Paul, Minnesota 55102
December 29, 2000
VIA FACSIMILE AND U.S. MAIL
Mr. Joel It Hanson
City Administrator
515 Little Canada Road
Little Canada, MN 55117
RE: Precision Landscape and Tree
Exclusive Option Agreement
Our File No. 8678
Dear Joel:
Telepbone
(651) 222.2541
Facsimile
(651) 223S269
I am in receipt of and have reviewed a copy of the Phase II Environmental Site
Assessment which was prepared for Precision Landscape and Tree relative to the Schreier
property. As you know, the Phase II indicates some environmental contamination exists on' the"
"'
site. Thus, even though the Phase II does not recommend any remediation, the City would incur
risk in acquiring the property if the environmental issues are not adequately resolved:
Therefore, as we discussed, we have prepared a proposed Exclusive Option Agreement
between the City of Little Canada and Precision Landscape and Tree. This Agreement would
give the City an exclusive right to purchase the, property if the property is not developed
consistent with the City's wishes, within one year from the date of the Agreement. The Option
Agreement would also allow us time to further evaluate the environmental concerns relative to
the subject property. Enclosed please find a4raft of said Exclusive Option Agreement.
After you have had a chance to review the document, please contact me with any
questions or concerns that you may have.
Very truly yours.
PJS:gc
Enclosures
& SWEENE'Y •
J.
