Hanson <br />www.ci.little-eanada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: November 9, 2001 <br />RE: Australian Assessment Appeals <br />We have received nine assessment appeals relative to the improvement of Australian Avenue. The <br />primary contention is the claim that the appellants were not "informed until after the assessment hearing <br />that the street may have additional restrictions placed upon it due to it being part of a trail system ". An <br />appeal from Jim Gregor is also included in this number. His is based upon the objections he filed at the <br />assessment hearing on October 10th. <br />Mr. Gregor was the only resident to file a written objection at or prior to the assessment hearing. <br />Therefore, I do not believe the other appeals will be found valid due to the fact they did not comply with <br />statutory requirements. <br />It should be noted that considerable discussion occurred relative to Australian being designated an on- <br />street path as part of our trail system. (This is documented in our neighborhood meeting minutes.) <br />However, the concern appears to focus on the possibility of parking restrictions due to this designation. A <br />report on this issue will be forthcoming in the future before this issue is resolved. <br />I would recommend we turn this matter over to the City Attorney for handling. I would also ask that he <br />comment on the validity of these appeals. <br />cc: Australian Appellants <br />Page 46 <br />
