DECLARATION OF COVENANTS AND RESTRICTIONS <br />THIS DECLARATION, made this day of , 2000 by William M. <br />Richie, a single person (hereinafter referred to as "Declarant "), fee owner of the subject property <br />legally described as follows: <br />That part of the Southwest Quarter of the Northwest Quarter of Section 4, township 29, <br />Range 22, Ramsey County, Minnesota described as follows: <br />Beginning at a point on the east line of the west 864.25 feet and 54724 feet north of the <br />south line of said Southwest Quarter of the Northwest Quarter of Section 4; thence North <br />64 degrees 06 minutes 51 seconds East, the east line of said west 864.25 feet has an <br />assumed bearing of North 00 degrees 59 minutes 58 seconds West, 205.00 feet; thence <br />North 25 degrees 53 minutes 09 seconds West 40.00 feet; thence North 47 degrees 41 <br />minutes 14 seconds West 135.90 feet to the south right of way line of Labore Road; <br />thence northeasterly, along said south right of way line, 310.89 feet to the east line of the <br />west 467.00 feet of the East Half of the Southwest Quarter of the Northwest Quarter; <br />thence southerly, along said east line of the west 467.00 feet, 1006.85 feet to the south <br />line of said Southwest Quarter of the Northwest Quarter; thence westerly, along said <br />south line, 467.00 feet to the west line of the East Half of the Southwest Quarter of the <br />Northwest Quarter of Section 4; thence northerly, along said west line, 140.00 feet; <br />thence easterly, parallel with said south line of the Southwest Quarter of the Northwest <br />Quarter, 200.15 feet to the east line of said west 864.25 feet of the Southwest Quarter of <br />the Northwest Quarter of Section 4; thence North 00 degrees 59 minutes 58 seconds West <br />407.20 feet to the point of beginning and there terminating, <br />(hereinafter referred to as the "Subject Property "). <br />WHEREAS, the term "further development" as contained herein, is defined as the <br />development of the eastern half of the Subject Property including the construction of a road <br />which accesses and intersects with Arcade Street. <br />PAGE 10 <br />
