Hanson, City Administrator <br />DATE: September 21, 2001 <br />RE: Condit Street Right -Of -Way Issues <br />On Thursday, September 20, 2001, I met with the Zoch's and Mr. Bougie to discuss <br />Condit right -of -way concerns. The primary focus of this discussion was a resolution <br />adopted at the May 22, 1985 Council meeting indicating that 8.5 feet of additional right - <br />of -way would be granted along the west side of Condit impacting the Zoch's property <br />and the Larry Lee development. The final plat as executed provided for an additional <br />13.5 feet of right -of -way. We could find no minutes revising the final plat to reflect the <br />13.5 feet of additional right -of -way. <br />The Zoch's want the Council to make a determination as to the appropriateness of that <br />situation. They would also like the Council to either compensate them for the additional <br />5 feet of right-of-way or return the right -of -way to them through a vacation. <br />I informed them that the City Attorney may have to render a legal opinion to the Council <br />before you would make a policy decision on this matter. I also informed them that from a <br />staff standpoint, my recommendation would be to retain the right -of -way as platted in <br />order to more closely meet City standards for street right -of -way width (46.5 feet of <br />right -of -way versus our standard of 50 feet). <br />Another issue I discussed with the Zoch's was the impact the reconstruction of Condit <br />would have on their existing trees. I indicated to them that based on the existing <br />pavement width of 26 feet in front of their home, 4 feet of additional pavement would be <br />necessary. It is my opinion that additional width could be added to their side of the street <br />without impacting the existing trees. However, construction of a retaining wall on the <br />west side of Condit may be necessary. I also informed them that I could not guarantee <br />that action at this time as conditions could change before the roadway is ultimately <br />reconstructed thereby impacting final design decisions. <br />Page 95 <br />
