Mn/DOT Agreement No. 81650 <br />Exhibit A <br />35.32 That if any funds other than Federal appropriated funds have been paid or will be paid to <br />any person for influencing or attempting to influence an officer or employee of any <br />Federal agency, a Member of Congress, an officer or employee of Congress, or an <br />employee of a Member of Congress in connection with this Federal contract, grant, loan, <br />or cooperative agreement, Contractor must complete and submit Standard Form -LLL, <br />"Disclosure Form to Report Lobbying," in accordance with its instructions. <br />35.33 That this certification is a material representation of fact upon which reliance was placed <br />when this transaction was made or entered. Submission of this certification is a <br />prerequisite for making or entering into this transaction imposed by 31 United States <br />Code Section 1352. Any person who fails to file the required certification will be <br />subject to a civil penalty. <br />35.34 That it must require that the language of this certification be included in all lower tier <br />subcontracts, which exceed 8100,000.00 and that all such subcontractors must certify <br />and disclose accordingly. <br />35.4 Contractor must comply with all applicable standards, orders, or requirements issued under <br />Section 306 of the Clean Air Act, 42 United States Code Section 7606; Section 508 of the Clean <br />Water Act, 33 United States Code Section 1368; Executive Order Number 11738, and all <br />applicable regulations promulgated by the United States Environmental Protection Agency. <br />Article 36 Data Disclosure <br />Contractor consents to disclosure of its social security number, federal employer tax identification <br />number, and/or Minnesota tax identification number to federal and state tax agencies and state personnel <br />involved in the payment of state obligations. These identification numbers may be used in the <br />enforcement of federal and state tax laws which could result in action requiring the Contractor to file <br />state tax returns and pay delinquent state tax liabilities, if any.
