2.11. "Construction Plans" means the Developer's plans and specifications and <br />related documents for the Developer's construction of the Minimum Improvements. The <br />Construction Plans must include at least the following: (a) site plans; (b) site grading and <br />drainage plans; (c) foundation plans; (d) basement plans; (e) floor plans for each floor; (f) <br />cross sections of each floor (length and width); (g) exterior elevations (all sides); and (h) <br />landscape plans; and shall be as detailed as the plans, specifications and related <br />documents which the City requires in connection with the issuance of a building permit; <br />2.12. "County" means Ramsey County, Minnesota; <br />2.13. "Developer" means Country Drive Invest rz, L.L.C.,Investments, LL,C, a <br />Minnesota limited liability company; <br />2.14. "Development District" means the City's Development District No. 2; <br />2.15. "Development Program" means the Development Program for <br />Development District No. 2, adopted by the City for the Development District; <br />2.16. "Development Property" means the land described on Exhibit A and any <br />improvements (including, but not limited to, any Minimum Improvements) and fixtures <br />(excluding tenant trade fixtures) located thereon; <br />2.17. "Environmental Law" means the Comprehensive Environmental <br />Response, Compensation and Liability Act, 42 U.S.C. Section 96.01 et seq., the Resource <br />Conservation and Recovery Act, 42 U.S.C. Section 69.01 et seq., the Hazardous <br />Materials Transportation Act, 49 U.S.C. Section 1802 et seq., the Toxic Substances <br />Control Act, 15 U.S.C. Section 2601 et seq., the Federal Water Pollution Control Act, 33 <br />U.S.C. sec. 1251 et seq., the Clean Water Act, 33 U.S.C. Section 1321 et seq., the Clean <br />Air Act, 42 U.S.C. sec. 7401 et seq., the Minnesota Environmental Response and <br />Liability Act, Minnesota Statutes ch. 115B, the Minnesota Petroleum Tank Release <br />Cleanup Act, Minnesota Statutes ch. 115C, and any other federal, state, county, <br />municipal, local or other statute, law, ordinance or regulation which may relate to or deal <br />with human health or the environment, all as may be from time to time amended; <br />2.18. "Event of Default" means any of the Events of Default described in <br />Section 11.1; <br />2.19. "First Mortgage" means a recorded Mortgage with priority over all other <br />Mortgages and liens on the Development Property (other than the lien for real estate taxes <br />and levied special assessments not yet due and payable) which the Developer grants to a <br />commercial lender or other financial institution to secure a loan the proceeds of which the <br />Developer is obligated to use to pay costs of constructing the Minimum Improvements; <br />1316916v1 <br />2.20. "Hazardous Substances" means asbestos, urea formaldehyde, <br />polychlorinated biphenyls ( "PCBs "), nuclear fuel or material, chemical waste, radioactive <br />material, explosives, known carcinogens, petroleum products and by- products and other <br />is <br />Page 47 <br />
