MINUTES <br />PLANNING COMMISSION <br />JULY 12, 2001 <br />Knudsen asked if the Commission was comfortable with the construction <br />materials for the garage. The City Planner pointed out that the <br />Commission can require the same materials as were used on the house, <br />including a matching garage door. <br />Roycraft stated that he had concerns with the proposal as well as the fact <br />that the property owner is not present. Roycraft stated that he is not <br />satisfied that he knows what the property owner intends to use the garage <br />for. <br />Carson recommended approval of the Conditional Use Permit allowing <br />construction of a 22 -foot by 34 foot accessory garage which will bring <br />total garage space to just under 1,500 square feet in size as requested by <br />Brett Pirkola, 2935 Edgerton Street, subject to compliance with the <br />recommendations of the City Planner as outlined in his report dated July <br />10, 2001, subject to access to the new garage being limited to access <br />through the existing attached garage, subject to the building materials and <br />color of the garage matching the existing house, including a matching <br />garage door, subject to there being no outdoor storage on the basketball <br />court, and subject to there being no business use of the garage. <br />Motion seconded by Wojcik. <br />Motion carried 6 — 1. Roycraft voted against. <br />ZONING The City Planner indicated that the Legislature has adopted a new statute <br />CHANGES that says that changes in zoning or changes to zoning maps are adopted by <br />simple majority. The City's Code required four votes for zoning changes, <br />and this State law supercedes the Code expect for a couple of narrow <br />situations. The Planner indicated that he will be bringing in a proposed <br />Code amendment for consideration at an upcoming meeting. <br />CUP'S FOR Duray suggested that perhaps some consideration should be given to <br />GARAGE establishing some specific criteria for large garages. <br />SPACE <br />The City Planner reported that the Council amended the Code relative to <br />CUP's for garage space a couple of years ago. While a CUP was needed <br />for garage space of 1,000 square feet or more, there was no maximum. <br />The Code was amended to establish a cap of 1,500 square feet. The <br />Planner also pointed out that the City can use the criteria mentioned earlier <br />in the meeting in considering these CUP applications. That criteria <br />includes the size of the property, size of the garage in relation to the house, <br />and impact the garage would have on surrounding properties. <br />4 <br />PAGE 25 <br />
