L. 93 -291) and Executive <br />Order 11593, including the procedures prescribed by the Advisory Council on Historic <br />Preservation in the Regulations at 36 C.F.R. Part 800. <br />9. ARCHITECTURAL BARRIERS <br />Any facility constructed pursuant to this Agreement shall comply with design <br />requirements of the Architectural Barriers Act of 1968 (42 U.S.C. § 4151) and the <br />Americans with Disabilities Act (42 U.S.C. § 12131). <br />10. ACTIVITIES FOR WHICH OTHER FEDERAL FUNDS MUST BE SOUGHT <br />The AGENCY may use Community Development Block Grant funds for the provision of <br />public services as described by 24 C.F.R. Section 570.201(e) provided that the AGENCY <br />meets the requirements of and follows the procedures outlined in 24 C.F.R. Section <br />570.607. <br />11. NON- PARTICIPATION IN POLITICAL ACTIVITIES <br />The AGENCY shall comply with the provisions of the Hatch Act (5 U.S.C. Ch. 15). <br />12. CONDITIONS FOR RELIGIOUS ORGANIZATIONS <br />Where applicable, the conditions prescribed by H.U.D. for the use of CDBG funds by <br />religious organizations shall be followed, and, if applicable, included in agreements <br />between the AGENCY and contractors or sub - contractors. <br />13. NATIONAL FLOOD INSURANCE <br />The AGENCY may not receive Community Development Block Grant funding for <br />acquisition or construction in any area that has been identified as having special flood <br />hazards and is not participating in the National Flood Insurance Program, as provided by <br />Section 3(a) of the Flood Disaster Protection Act of 1973 (Pub. L. 93 -234) and the <br />Regulations thereunder. The AGENCY shall comply with the Regulations at 24 C.F.R. <br />Section 570.605. <br />14. AIR AND WATER POLLUTION <br />The AGENCY shall comply with the provisions of the Clean Air Act, as amended (42 <br />U.S.C. Section 7401 et seq.) and the Federal Water Pollution Control Act, as amended (33 <br />U.S.C. Sections 1251, et seq.) and the regulations issued thereunder. <br />15. LEAD -BASED PAINT POISONING <br />The AGENCY shall comply with the H.U.D. Lead -Based Paint Regulations (24 C.F.R. <br />Part 35) issued pursuant to the Lead -Based Poisoning Prevention Act (42 U.S.C. Sections <br />Page 19 <br />
