The Association is made up of 96 townhouse dwelling units located just north <br />of Pioneer Park. 29 of the townhouse units face the city's Allen Avenue. The remaining 67 <br />units are located on the five cul -de -sacs listed above. The cul -de -sac streets are part of <br />Pitrina Park Terrace and are not city streets. <br />We have not made a detailed study, but it appears that the folks living on the cul -de -sacs <br />pay no less in local taxes than the folks living in equivalent dwellings facing Allen Avenue. <br />Allen Avenue, of course, is swept, snow - plowed and otherwise maintained by the City. <br />The cul -de -sacs are maintained by the Homeowners Association -- paid for by all <br />members of the Association. <br />It would seem most equitable and most efficient to have coordinated services for the entire <br />subdivision. The five small cul -de -sacs all adjoin Allen Avenue, and it would not involve a <br />significant increase in the expenditure of time or materials for the city to serve its citizens who <br />reside on these cul -de -sacs. Accordingly, the Board proposes, subject to its right to do so, <br />to transfer to the City of Little Canada title to the aforementioned five cul -de -sacs. In the <br />alternative, the existing Easement to City provided in the Pitrina Park Terrace Declaration <br />(Article VIII, Section 5) could be construed to permit the City to maintain the cul -de -sacs <br />without actually transferring title. The section reads: <br />The title of the Association and the Owners of Lots in and to the <br />Common Elements is hereby made subject to a non - exclusive <br />easement in favor of the City of Little Canada for the purpose of <br />ingress and egress for police, fire, rescue and other emergency <br />calls, animal control, health and prospective inspection and to <br />provide the Owners other public services deemed necessary <br />by the City of Little Canada and for the purposes set forth herein. <br />Page 36 <br />
