MINUTES CITY COUNCIL JUNE 27, 2001 PITRINA PARK REQUEST FOR CITY TO TAKE OVER PRIVATE STREETS *APPROVING THE VOUCHERS The foregoing resolution was duly seconded by Fahey. Ayes (5) LaValle, Fahey, Scalze, Anderson, Montour. Nays (0). Resolution declared adopted. Mr. Carl Helgeson, President of the Pitrina Park Homeowners Association, appeared before the City Council requesting that the City take over the ownership and maintenance of the five private cul -de -sacs in Pitrina Park. Helgeson pointed out that the property owners in Pitrina Park pay high property taxes and are not getting the same services that other property owners receive. Helgeson requested that based on the issue of fairness, the City take over the maintenance of these cul -de -sacs. Fahey pointed out that the difficulty is that the cul -de -sacs were not constructed to City standards with regard to both construction and amount of right -of -way. Fahey also noted that the setbacks of the townhomes from the cul -de -sacs would not meet the City's minimum setback requirements. These issues were discussed with the developer at the time Pitrina Park was proposed, and the developer requested the cul -de -sacs be private. Fahey pointed out that the Council discussed with the developer in no uncertain terms that these cul- de -sacs would not be City streets and would remain the responsibility of the developer or townhome association. Fahey stated that he did not feel it was unfair not to accept the cul -de -sacs as public streets. Helgeson reported that not all the Pitrina Park property owners knew the cul- de -sacs were private at the time they purchased their townhome. Helgeson indicated that he did some measuring of some other streets in town and found cul -de -sac areas to be smaller than those in Pitrina Park, specifically that of Savage Lane. Scalze pointed out that the Savage Lane cul -de -sac may be narrower given that the freeway went in after the street already existed. Scalze also pointed out that right -of -way is not the same as pavement width. In the case of Pitrina Park, there is inadequate right -of -way. Helgeson pointed out that the City never asked the Pitrina Park homeowners if they wanted the cul -de -sacs as private. The issue was between the City and the developer. Helgeson pointed out that the developer wanted private cul -de -sacs in order to maximize his space, and the City wanted to maximize property taxes. Page 44
