Hanson <br />Enclosed under separate cover is the draft ot. the proposed development agreement <br />amendment with RAB, LLC for the Country Drive redevelopment area. As you know, <br />the developer is in default of the original development agreement with the following <br />issues currently outstanding: <br />+ Filing of plat for the entire development area. (This has been delayed primarily due <br />to the fact the developer set the plat up with himself as the owner of the entire parcel. <br />The City still holds title to the north acre and one-half and would need to be a co- <br />signer on the piat. The developer feels it would be more efficient to close on the <br />property and record the plat at that time to avoid redrawing.) <br />• Construction financing for Phase TI buiiding. (The developer indicates this is <br />forthcoming pending approval of the buiiding permit.) <br />+ Issuance of a building permit for Phase 11 construction. (Construction plans were <br />submitted on June 20a`. No application or fees have been filed. Fire suppression <br />plans have also not been included.) <br />• Execution of an assessment agreement for Phase I1 property. (The developer could <br />'execute this agreement at this time. However, it won't be in final form until Ramsey <br />County signs off on it. They will need to review building plans before doing so and it <br />is likely this would take some time.) <br />In the proposed development agreement amendment these issues as well as others have <br />been addressed. Key points are as follows: <br />+ Building permit issuance, construction financing, developer execution of an <br />assessment agreement, commencement of construction are to all occur within the next <br />few days. <br />Page 52 <br />
