MINUTES <br />CITY COUNCIL <br />FEBRUARY 14, 2001 <br />ALCOHOL Mr. Tom Vogt, owner of Gas N Go, appeared before the Commission to <br />COMPLIANCE discuss a recent alcohol violation which occurred at Gas N Go wherein a <br />VIOLATION — clerk sold alcohol to an underaged individual. Vogt reported that the clerk <br />GAS N GO was a good employee, but made a mistake. While he was not happy about the <br />situation, he has decided to continue her employment. Vogt reported that this <br />SW has been a learning experience for them, and they would make improvements <br />and move on from this point. He noted that he has been in business at Gas N <br />Go for the past 8 years and has not had a problem up until now. <br />CONSENT <br />AGENDA <br />The Council discussed the fact that criminal charges have been filed against <br />the clerk who made the sale, and it was the consensus of the Council to delay <br />action on the administrative penalty to the business owner pending the <br />outcome of the criminal action. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001 -2 -37— TABLING ACTION ON THE <br />ADMINISTRATIVE PENALTY ACTION FOR GAS N GO ALCOHOL <br />VIOLATION PENDING RESOLUTION OF THE CRIMINAL ACTION <br />RELATED TO THIS MATTER <br />The foregoing resolution was duly seconded by Mr. LaValle. <br />Ayes (5) Scalze, LaValle, Montour, Anderson, Fahey. <br />Nays (0). Resolution declared adopted. <br />It was noted that Gas N Go was the only failure of the businesses at which <br />alcohol compliance checking occurred. <br />Mr. Anderson recommended that the City Administrator send letters to those <br />businesses that passed the alcohol compliance checking congratulating them on <br />their success. The Council agreed. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001 -2 -38 — APPROVING THE CONSENT AGENDA <br />WHICH CONTAINS THE FOLLOWING ITEMS: <br />*APPROVING AN ORDINANCE AMENDING PROHIBITED DAYS FOR <br />OFF -SALE LIQUOR SALES AS RECOMMENDED BY THE CITY <br />ATTORNEY; <br />Page 4 <br />
