AGREEMENT NO. PW2000 -19 <br />AGREEMENT FOR WINTER ROAD MAINTENANCE SERVICES <br />BETWEEN <br />RAMSEY COUNTY AND THE CITY OF LITTLE CANADA <br />This agreement is entered into between the City of Little Canada, Minnesota, ( "City ") and the <br />County of Ramsey, ( "County"). <br />WHEREAS, the County is responsible for the maintenance of Little Canada Road from <br />Highway 49 to County Road C (0.65 mile) located in the City of Little Canada; and <br />WHEREAS, the City wishes to assume responsibility for winter road maintenance of this road <br />for the winter of 2000 -2001 at no cost to the County; and <br />WHEREAS, the City, through Little Canada Public Works Department, is responsible for the <br />maintenance of certain roadways within the City; and <br />WHEREAS, the City has the staff, equipment and proximity to these roadways to provide the <br />routine winter maintenance necessary on the roads <br />The parties mutually agree as follows: <br />1. Services: The services which the City shall perform are as follows: <br />a. The City shall provide winter road maintenance on the following County roadway, as <br />described below: <br />Little Canada Road from Highway 49 to County Road C (0.65 mile) <br />b. The term "winter road maintenance" shall mean to keep the aforesaid portion of County <br />roadway reasonably free and clear from ice, snow and debris, and undertake proper <br />sanding and/or salting when necessary. It shall be the City's responsibility to maintain <br />the through traffic lanes to their fullest width practical during the winter months while <br />allowing for the protection of the newly installed concrete curb and gutter. <br />c. The City shall furnish all equipment, materials and staff necessary to provide winter <br />road maintenance. <br />2. Relationship between the parties: <br />a. It is agreed that nothing contained in this Agreement is intended or should be <br />construed as creating the relationship of agents, partners, joint venturers, or <br />associates between the parties hereto or as constituting the City as the employee of <br />the County for any purpose or in any manner whatsoever. The City is an <br />independent contractor and neither it, its employees, agents nor representatives are <br />employees of the County. <br />Page 35 <br />
