7. At the time that an animal impounded under this contract is reclaimed, "ACSI" or its agent <br />shall collect the impounding fee and boarding charges as provided by "City" Ordinance. All <br />impounding fees and/or any other penalty fees collected by "ACSP' or its agent shall be <br />remitted to the "City". <br />8. In the event an animal impounded and boarded by order of the "City" Health Officer or <br />placed under quarantine by ruling of the State Board of Health, said animal shall be boarded <br />as required by said order or ruling. At the end of such period, the "City" shall release all of <br />its interest, right and control over said animals that may then be disposed of at the discretion <br />of "ACSP'. In the event that any dogs, cats, or other impounded animals are unclaimed after <br />six (6) days, they shall become the property of "ACSP' and may be disposed of or sold at <br />their discretion. All proceeds from the disposition of such annuals may be retained by <br />"ACSP' including any proceeds received from any animals disposed of in accordance to <br />Minnesota Statutes 35.71. <br />9. The "City" shall furnish to "ACSI" any special forms or receipts specified in the "City" <br />Ordinance and "ACSP' shall keep records of all animals impounded together with a <br />description of the same. <br />10. "ACSP' shall assume liability for all harm to animals due to is negligence or that of its <br />agents in not properly caring for the same, and agrees to defend any lawsuits arising there <br />from. "ACSP' shall defend, indemnify, and hold the "City" harmless including its officers, <br />employees or agents from any and all claims, suites, losses, damages, or expenses on account <br />of bodily injuries, sickness, disease, death, and property damage including injury to animals <br />and the result of, or alleged to be the result of "ACSP' shall provide the City of Little <br />Canada proof of public liability insurance including comprehensive automobile liability in <br />an amount of at least $500,000.00 per each claimant and $1,000,000.00 per occurrence. <br />11. The "City" agrees to pay "ACSI" for services in the performance of this contract as follows: <br />A. Price per hour /per vehicle for scheduled patrol based on Four (4) hours of patrol per <br />week for actual time in service. $26.00 <br />B. Price per call — per vehicle for service during scheduled or regular working hours. <br />After Hours Call -out unscheduled <br />Special Callout 1 6:00 pm till 10:00 pm $52.00 <br />Special Callout 2 10:00 pm till Midnight $66.00 <br />Special Callout 3 Midnight till 7:00 am $71.00 <br />Weekends and Holidays $66.00 <br />Page 39 <br />
