Paragraph 4 of that Permit Agreement <br />authorizes: <br />"the right to construct and maintain a parking lot or area for light <br />storage within, over and across the easterly twenty (20) feet of the <br />Premises" as well as the right to "construct and maintain a fence." <br />The nature of the material and equipment stored in the permitted area, as observed by Board <br />staff, appears to exceed the definition of Tight storage, and as such, appears to violate the <br />authority outlined above. <br />In addition and more importantly, it appears there are activities occurring on land that is located <br />outside of the permitted area. In other words, it appears that unauthorized activities are also <br />taking place on Board - controlled land that is not subject to the Permit Agreement. These <br />activities include the placement of a shed, a semi- trailer, machinery and large boulders. Board <br />staff views this as an encroachment on its easement. <br />The Board respectfully requests that you comply with the terms and conditions of the Agreement <br />and immediately suspend any land use activities which are contrary to the authority granted <br />therein.
