With regard to the setback, the applicant argues that meeting the 15 foot setback will
eliminate an existing overhead door which is critical to the operation of the business. At
issue is whether the expansion itself is crucial to the continued operation. The applicant
suggests that the federal safety regulations under OSHA suggest, but do not mandate, that
the paint booth operation is updated. To approve the setback variance, the City should
find that the expansion and updating of the paint equipment is necessary to allow
reasonable use of the property, and that meeting the 15 foot setback would interfere with
this use.
cc: Kathy Glanzer
Greg Schroeder
Steve Westerhaus
Terry Maurer
Dennis O'Connell
Page 36
