MAYOR
Michael 1. Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Steve Morelan
Bob Pedersen
515 Little Canada Road Little Canada. MN 55117 -1600 ADMINISTRATOR
(651) 484 -2177 / FAX: (651) 484 -4538 Joel R. Hanson
Email: cityhall @ci.little- canada.mn.us
MEMORANDUM
TO: Mayor Fahey & Members of the City Council
FROM: Joel Hanson, City Administrator
DATE: September 22, 2000
RE: Vacation of Drainage Easement
Attached is the information relative to vacation of the drainage easement on the Kerr property at
627 Keller Parkway. Answers to questions asked at the last Council meeting are as follows:
• Part of the existing wetland area is being filled.
• Filling of this wetland complies with the Wetland Conservation Act due to a
deminimus exemption when the area is less than 2,000 square feet.
♦ A hardship must be demonstrated in order for the Watershed District to grant a
deminimus exemption and one existed in this case.
♦ The wetland area is being restored as indicated in the letter from Jason R. Naber of
Emmons & Olivier Resources.
Given the information presented, it is staff's recommendation that the vacation be approved as
presented.
cc: Denise Kerr
Frank Frattalone
H: \KrisP \CORRESP\2000 \Kerr Vacation.doc
Page 53
