N*CC
MEMORANDUM
NORTHWEST ASSOCIATED CONSULTANTS
COMMUNITY FLAN N I NG - DESIGN - MARKET RESEARCH
TO: Little Canada Planning Commission
FROM: Stephen Grittman
DATE: July 10, 2000•
RE: Little Canada - Valento. Setback Variance
FILE NO: 758.09 - 00.20
Background /Analysis
Don Valento has applied fora.variance to the side yard setback requirements for a.parcel
in Ryan Industrial Park at'3179. Spruce Street. The site is zoned 1 -1, Light Industrial. The
site is developed with an industrial building, and abuts the Burlington Northern Railroad
on the north and the St. Paul Waterworks on the west.
The applicant would like to construct a 40 foot by 26 foot accessory building for use as-a
storage' area for the existing building tenants. Two semi - trailers which were previously
used for storage were required to be removed from the property by previous Council
action. Due to the configuration of the site, the applicant is requesting a reduction of the
setback requirement on his northerly side yard from fifteen feetto five feet.
The configuration of property along the BN railroad has been the. basis for two setback
variances on adjacent land. Both the Belland auto repair facility and the Stanke industrial
building were granted a five foot setback from the railroad, both rear yards. The applicant
in this case has stated that the waterworks easement restricts him from constructing the
building to the rear of the lot where it might otherwise meet the setback requirements, and
the additional covered storage area is necessary.
The Zoning Ordinance states that configuration of an existing parcel is one of the possible
criteria for variance consideration. Moreover, it states that the City must not deny a
variance for rights which are commonly enjoyed by other properties in the same zoning
district. With these considerations, staff believes that the variance request is appropriate
5775 WAYZATA BOULEVARD, _E' --__
PHONE 612-595-9636 FAX
Page 6
UIS PARK, MINNESOTA 55416
E -MAIL NAC @ WINTERNET.COM
