suburbs of Saint Paul. It will be located in Little Canada street right of way along First Bank <br />Drive between Middle Street and Market Place Drive. This Project will enable the Council to <br />improve suburb -to- suburb and reverse commute service in the Saint Paul Northeast Corridor. <br />The Project is intended to accommodate the increased transit activity in the area until a <br />permanent facility can be built. <br />This agreement provides for the City's Contractor to construct the Project for the Council <br />through the City's issuance of a change order to the agreement between the City and the <br />Contractor, dated July 5, 2000, relating to Ramsey County Project Number 8057503 (Little <br />Canada Road Improvements). The Council will pay for all costs to design and construct this <br />Project, including street and facility improvements as referenced in the change order, costs for <br />purchase and installation of street lighting and planters by the City or its Contractor, costs for <br />preparation of this joint powers agreement, and City administrative costs to complete the Project. <br />The City will pay its Contractor directly. This agreement also allocates the rights and <br />responsibilities of the parties in relation to the Interim Rice Street and Little Canada Transit Hub <br />Project. <br />III. CONSTRUCTION OF THE TRANSIT HUB <br />3.01 Design. The Council will prepare design plans and specifications for construction <br />of the Interim Rice Street and Little Canada Transit Hub Project. The design must meet all <br />applicable federal, state, and local requirements for transit facilities, including the ADA. Unless <br />specified in the change order, all specifications will follow those of Project 8057507. Approval <br />of these plans and specifications by the Council shall in no event be deemed to warrant the <br />quality of the materials used in the construction of any portion of the Project. <br />3.02 Contract Documents. The City will prepare a change order to its agreement with <br />the Contractor, dated July 5, 2000, for construction of the Interim Rice Street and Little Canada <br />Transit Hub Project according to the Council's design plans and specifications. The City will <br />prepare the documents in compliance with all applicable federal, state, and local requirements. <br />Page 135 <br />
