The City shall be responsible for maintenance of the planters and street Lights installed as part of <br />this Project. <br />6.02 Signage. All signs placed on the Transit Hub improvements by the Council shall <br />be installed, maintained, repaired, and replaced by the Council. All signs placed on the Transit <br />Hub improvements by the City shall be installed, maintained, repaired, and replaced by the City. <br />All signage to be placed on the Transit Hub shall conform to regional standards and shall be <br />subject to approval by the Council. <br />6.03 Emergency Repairs or Maintenance. Any provision of this agreement to the <br />contrary notwithstanding, if any repair to or maintenance of the Transit Hub is not done by the <br />party obligated by this agreement to do such repair or maintenance, and if, in the reasonable <br />opinion of the City or the Council, an emergency exists which requires that such repair and <br />maintenance be done immediately, then such repair and maintenance may be done by the City or <br />the Council, and the cost may be recovered, upon demand, by the party doing the repair or <br />maintenance from the party obligated by this agreement to pay for the cost of the repair and <br />maintenance. <br />VII. TERM <br />This agreement shall be in force and effect as of the date of execution by both parties. The City <br />will complete the Project no later than December 31, 2000. The term of this agreement and of all <br />easements, access rights, rights of entry, and permits granted pursuant to this agreement shall <br />remain in effect as provided in paragraph 5.02, unless otherwise agreed by the parties. At such <br />time that the Transit Hub is no longer in regional transit .use, the Council agrees to notify the <br />City, remove the passenger waiting shelters, and perform such work as to leave the site in a <br />condition reasonably satisfactory to the City. This work shall be performed within sixty (60) <br />days of Council notice to the City that the Council has ceased regional transit use of the Transit <br />Hub. <br />Page 139 <br />
