The Board also requests that you suspend any <br />activities which encroach on the Board's easement and that you remove or relocate any <br />obstructions, facilities or structures that are located upon, over or within the Boatel's easement. <br />As you may be aware, the Permit Agreement is scheduled to terminate on or before October 18, <br />2003. Although the Permit Agreement gives the parties the opportunity to.extend the term of the <br />agreement for an additional time period, the current position of Board staff is to deny any request <br />for an extension absent strict compliance with the terms of the Agreement. Board staff will also <br />recommend that parties construct and maintain a fence at a distance of twenty-dye (25) feet west <br />of the east line of the Premises (as outlined in paragraph 4 of the Permit Agreement) before any <br />extension be granted. <br />Thank you for your immediate attention to this matter.
