MINUTES <br />CITY COUNCIL <br />JULY 26, 2000 <br />* A determination of whether or not a variance is needed <br />in order to place the accessory building in the side yard <br />adjacent to the principle structure. <br />Morelan asked if the property line would change if the Water Department <br />acquired some of the property by eminent domain. The City Planner <br />replied that it would. Morelan asked if the City would have any input in <br />this matter. Pedersen felt the City would not be asked to comment or act <br />on such an action. <br />Valento reported that he owns the 60 -foot easement area that the Water <br />Department has. Valento indicated that of the 60 feet, he can use the first <br />25 feet, but the remaining 35 feet cannot be used. Valento's concern was <br />that the Water Department may want ownership of the 35 feet. <br />Fahey indicated that he was not concerned about the easement area, but <br />suggested that staff attempt to clarify the Water Department's plans for <br />this area. Fahey pointed out that the Council has taken the position that it <br />would not approve accessory buildings if the use of such a building is a <br />means of avoiding installation of a sprinkler system. Fahey suggested that <br />the. Building Inspector determine if it is possible to install a sprinkler <br />system in the building. <br />The City Administrator- suggested that Mr. Valento submit whatever <br />reports he might have relative to installing a sprinkler system. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000 -7 -173 — TABLING ACTION ON THE <br />VARIANCE REQUEST FOR 3179 SPRUCE STREET UNTIL THE <br />AUGUST 9, 2000 COUNCIL MEETING AND REQUESTING THAT <br />CITY STAFF CLARIFY THE ST. PAUL WATER DEPARTMENT'S <br />POSITION WITH REGARD TO THE EASEMENT AREA ON THIS <br />PROPERTY AS WELL AS HAVING THE BUILDING INSPECTOR <br />REVIEW AND COMMENT ON THE ISSUE OF INSTALLATION OF <br />A SPRINKLER SYSTEM IN THIS BUILDING, AND DETERMINING <br />WHETHER OR NOT A VARIANCE IS NEEDED IN ORDER TO <br />PLACE THE ACCESSORY BUILDING IN THE SIDE YARD <br />ADJACENT TO THE PRINCIPLE BUILDING <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Morelan, Pedersen. <br />Nays (0).
