Hanson <br />Email: cityhall @ci.little - canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Kathy Glanzer, Deputy Clerk <br />DATE: August 16, 2000 <br />RE: Conditional Use Permit & Variance — Tacheny Property <br />On June 6, 2000, Chris Nitardy, Alexander Homes, and Wendy Tacheny, 743 East <br />County Road B -2, came to the City Center to make application for a Conditional Use <br />Permit for accessory garage space of approximately 1,300 square feet. At that time, Mr. <br />Nitardy asked me what the chances of approval were for the Conditional Use Permit. I <br />told Mr. Nitardy and Mrs. Tacheny that in my experience with past Conditional Use <br />Permit applications for accessory garage space, it has been rare that the City Council has <br />denied these CUP's as long as the space did not exceed 1,500 square feet. There was no <br />discussion whatsoever about setbacks or the placement of the Tacheny's proposed <br />accessory garage on the lot. <br />Mr. Nitardy then informed me that a cement contractor would be working on the <br />foundation for the house and indicated that it would be cost - effective for them to have the <br />foundation work done for the accessory garage at the same time. Mr. Nitardy asked if <br />construction could start on the accessory garage. <br />I then asked the City Administrator to join in the discussion. He informed Mr. Nitardy <br />and Mrs. Tacheny that City staff could not authorize construction of the accessory garage <br />to begin without a building permit. Also, a building permit could not be issued until CUP <br />approval was granted by the City Council. If any construction were commenced prior to <br />issuance of the CUP, that work would be entirely at the risk of the property owner.
