MINUTES <br />PLANNING COMMISSION <br />JULY 13, 2000 <br />At this point in the meeting, 8:15 p.m., Mr. Montour had to leave. <br />Barraclough reported that he has difficulty with the variance request in <br />view of the fact that just a few months ago the O'Neil's requested the <br />property division and assured the City that access could be provided via <br />Keller Parkway. Barraclough indicated that he hoped the issue could be <br />worked out and a compromise reached with the neighbors. <br />Keis recommended that the application for Variance from the requirement <br />for direct access to a public street allowing access for a lot located on <br />Keller Parkway via a driveway easement to LaBore Road as requested by <br />Theodore and Patricia O'Neil be tabled until the August 10th Commission <br />meeting in order to allow the property owner and neighbors an opportunity <br />to try to work out a compromise. <br />Motion seconded by Kraemer. <br />Motion carried 5 — 0. <br />CUP — The City Planner reported that Mr. and Mrs. Tacheny have applied for a <br />743 EAST Conditional Use Permit to allow total garage space of approximately 1,300 <br />COUNTY square feet at 743 East County Road B -2. It has just been learned that the <br />ROAD B -2 — Tacheny's have poured the slab for the garage space prior to receiving <br />TACHENY CUP approval, and that slab does not meet the City's setback <br />requirements. Therefore, a variance would be required to allow the garage <br />to be constructed in that location. The Planner has suggested to the <br />Tacheny's that they apply for the Variance, and that both the CUP and <br />Variance applications be considered at the same time. That consideration <br />should occur at the August 10th Planning Commission meeting. <br />Keis suggested that the Building Inspector make sure that there is no <br />additional construction on the garage, and that a stop work order be issued. <br />There were several neighboring property owners present, and one was <br />concerned that the Tacheny's would be running a business from their <br />property. It was pointed out that the type of business the Tacheny's have <br />would require a CUP. The Tacheny's have indicated that the garage space <br />they are requesting would be for personal use only. <br />Another resident pointed out that the location of the slab appears to be too <br />close to the road. The residents were very concerned that no additional <br />work be allowed on this garage pending completion of the public hearing <br />process. <br />Page 16 <br />
