We have <br />received the notice from the City of Little Canada regarding the above- referenced request for <br />variance. <br />As one of the adjacent land owners, I am writing to oppose any variance from the <br />requirement that all lots in Little Canada have direct access to a public street. I oppose the <br />variance for the following reasons: <br />1. Variance Is Not Appropriate under Zoning Code - Section 922.010 of the Little <br />Canada Zoning Ordinance governs the granting of variances. We have reviewed <br />the information College City Homes has provided to the City in connection with <br />the requested variance, and the O'Neils and College City Homes have failed to <br />demonstrate a need for the variance pursuant to Section 922.010 C.2. <br />2. Inaccurate Representations Made During Subdivision Process - In connection <br />with the recent subdivision of 666 LaBore Road, in response to direct inquiries at <br />the Planning Commission meeting regarding the intended access to the newly <br />created lot, Patricia O'Neil stated that the new home would have access to Keller <br />Parkway and would not require access to LaBore Road. See the Minutes of the <br />Planning Commission dated March 9, 2000 for a summary of the inquiries made. <br />In addition, see the Memorandum dated March 8, 2000 from Stephen Grittman of <br />Northwest Associated Consultants ( "NAC ") to the Little Canada Planning <br />Commission in connection with the proposed subdivision.
