Property <br />FILE NO:.. 758.10 -00.15 <br />At its July 27 meeting, the City Council discussed the possibility of reducing setbacks on. <br />propertywhich.abuts undevelopable land, such as railroads, the Water Works right of way, <br />or freeway property. There have been a few recent setback variance requests which have. <br />relied on the status of the adjacent property* rationale for their variance application. The <br />Zoning Ordinance applies the following criteria for consideration of variances: • <br />a. Special conditions and circumstances exist. which. are. peculiar to. the land, <br />structure, or building involved.. <br />(1) <br />'Special conditions may include exceptional topographicorwaterconditions, <br />or, in the case of an existing. lot of recond, narrowness, shallowness, <br />insufficient area or shape of the property. <br />(2) . > Special conditions and circumstances may not be primarily economic in <br />nature. <br />Literal interpretation ofthe provisions of this Oniinance would deprive the applicant <br />ofrights armmonlyenjoyed by otherproperties in the sameiilstrlct under the terms • <br />of this Ordinance. • <br />The Special 'conditions and circumstances do not result from the actions of the <br />applicant. <br />5775 WAYZATA BOULEVARD, SUITE 555' ..ST. :LOUIS : PARK.
