802.050. FEES. <br />(a) At the time of filing an application for a license to <br />engage in the business of selling Tobacco Products, the <br />applicant shall deposit with the City Administrator the <br />sum of Fifty and no /100 Dollars ($50.00), and the City <br />Administrator shall thereupon deliver the applicant a <br />receipt therefore containing a statement of the purpose <br />for which this deposit was made and a copy of said <br />receipt shall be attached to and filed with the <br />application. <br />(b) The annual Tobacco Products license fee shall be <br />determined by resolution of the City Council. If the <br />application is made after January 1, the annual fee shall <br />be pro -rated on a monthly basis. However, the minimum <br />fee shall be Fifty and no /100 Dollars ($50.00). <br />802.060. TERM. Tobacco Products licenses shall be for a term <br />of one year. The annual Tobacco Products license shall commence <br />July 1 of each year. <br />802.070. LICENSE RESTRICTIONS. A license shall be issued <br />subject to the following restrictions: <br />(a) Vending machines used to dispense Tobacco Products shall <br />be prohibited unless the following conditions are met: <br />(1) The vending machine shall be operable only by the <br />activation of an electronic switch operated by an <br />employee of the licensee before each sale, or by <br />insertion of a token provided to the purchaser by <br />an employee of the licensee; and <br />(2) The vending machine shall be located in the <br />immediate vicinity, plain view and control of a <br />responsible employee of the licensee, so that all <br />purchases will be readily observable by the <br />employee of the licensee. The vending machine <br />shall not be located in a coatroom, restroom, <br />unmonitored hallway, outer waiting area or similar <br />unmonitored areas. The vending machine shall be <br />inaccessible to the public when the establishment <br />is closed. <br />(b) Other than Tobacco Products packaged in cartons <br />containing at least ten (10) individually packaged <br />Tobacco Products, a licensee shall not offer for sale or <br />otherwise dispense any Tobacco Product by self- service <br />merchandising. <br />Page 8 <br />
