comments as to parking capacity for special events, bus access and loading zone, and <br />other site planning details. The applicant requires the approval of the adjacent child care <br />center operator to construct a bus loading zone as proposed on the concept plan. It does <br />not appear feasible to accommodate bus turning within the existing parking area. Site plan <br />approval, if considered, should be made contingent on the development of a more <br />complete plan for City review. <br />Summary and Recommendation <br />The City has three options to pursue in this request. One option would be to deny the <br />rezoning and not allow the establishment of the charter school. The second and third <br />options would allow the charter school under alternative zoning district, P, Public or an <br />amended R -B District. <br />Alternative Decisions <br />1. Deny the rezoning, based on a finding that the R -B District is appropriate for the <br />site as directed by the Comprehensive Land Use Plan. <br />2. Approve the rezoning to P, Public based on a finding that the Public District is <br />consistent with the Comprehensive Land Use Plan; and <br />a. Consider the proposed amendment to the PUD based on the concept site <br />plan previously submitted by the applicants <br />3. Approve an amendment to the R -B Zoning District establishing schools as a <br />Conditional or Interim Use in the R -B District. <br />a. Consider a CUP or IUP for the proposed charter school, with conditions as <br />listed in the original staff report, dated May 9, 2000, as well as other <br />conditions of City staff. <br />As noted in the body of this report, the City has the greatest degree of discretion at the <br />zoning level. If the City wishes to approve the charter school at this location, a rezoning <br />to P, Public District would be appropriate, coupled with the control of a Planned Unit <br />Development amendment necessary on this site. This would avoid concern that public <br />uses may be requested on other R -B properties. If an amendment to the R -B District is <br />pursued, we would recommend the Interim Use Permit approach to allow the City to <br />specify a termination date for the permit as appropriate.
