Hanson <br />Email: cityhall@ci.little - canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: May 5, 2000 <br />RE: Clarification of restrictive covenant — Richie subdivision <br />At our February 23 Council Meeting, we approved the division of the Richie property at 2966 <br />LaBore Road as requested, subject to Mr. Richie agreeing to a covenant that would preclude any <br />additional development of his property without a road improvement, and subject to compliance <br />with the recommendations of City Planner and Planning Commission. Attached is a draft of a <br />declaration of covenant and restrictions that were prepared by the City Attorney's Office. You <br />will note that it prohibits any future subdivisions by the declarent heirs survivors etc. <br />Kathy Richie has a concern with the language in that it would prohibit any movement of lot lines <br />that may be to their advantage depending on future situations. (i.e., gaining an additional 10 feet <br />of lot area if Bill ever consider selling his house.) They do not object to the issue of being <br />prohibited from creating any new lots from these properties, but they would like to have the <br />flexibility of moving lot lines as long as future development of the area is not compromised. <br />The City Attorney will review this matter with the council at Wednesday's meeting to seek <br />appropriate clarification.
