CHAPTER 9 <br />RESIDENCE ONE DISTRICT <br />4) Articles not produced on the premises shall not be sold on the premises. <br />5) Hours and intensity of operation may be limited and shall be set forth in the <br />special use permit. <br />6) On -site advertising may be limited or prohibited and any restrictions thereon <br />shall beset forth in the special use permit. <br />7) If the home occupation requires a license, the restrictions Imposed in the <br />special use permit shall become a part of such license: violation of either the <br />license requirements or special use permit shall cause forfeiture of both the <br />license and the special use permit. <br />8) If a home occupation is a service business, confined to business by mail or <br />phone. with no outside merchandise delivery, no on -site advertising, no on -site <br />customers, and no outside employee, then the City Clerk- Administrator may <br />process the application with staff recommendation to the council, and the <br />council may act upon the same without a planning commission or city council <br />hearing and without posted, published, or mailed notice. Any permit granted <br />under this subpart shall set forth and bind the applicant to all relevant <br />restrictive conditions. <br />(d) Boarding (house) home - foster children. Restricted to children out of their own <br />homes, age sixteen years or under, tared for twenty-four hours a day. The number to <br />be cared for in one foster child boarding (house) home shall not exceed ten, including <br />the foster family's ;own children. <br />(t) Livestock Raising according to the following conditions: <br />I) A minimum of one acre of land must be available. <br />2) Feed lots, fenced nuns, pens and similar intensively used facilities for animal <br />raising shall not be located within 300 feet of a neighboring property. <br />3) Fann buildings, other than dwellings, shalt not be located within 300 feet of a <br />neighboring property: <br />4) No surface water shall be allowed to run off of the area where animals are <br />kept. <br />5) No other condition shall be allowed which will have a deleterious effect on <br />surrounding property. <br />(g) Riding Stables or Horse Raising according to the following conditions: <br />I) Each horse kept primarily for riding shall be maintained on at least one acre <br />of land per horse, and the land where such horse is kept shall be (a) entirely <br />fenced so as to contain the horse within such land, and (b) adequately drained <br />so as to cause no health hazard or nuisance to adjacent property. <br />The fence in (a) above shall be constructed within all zoning set back lines <br />and be more than 100 feet from any adjacent residential structure. <br />(h) Accessory shed In excess of 120 square feet. <br />25 <br />Page 76 <br />
