MINUTES City Council Dec. 30, 1987 Bank Shot Billiards (Cont.) VanGuilder Rezoning Request 206 Little Canada Road Agenda Item No. 6 Scalze reported that she was opposed to the CUP as she felt the billiard center would be too close to the residential property to the north. Scalze also did not feel the use was the best for the shopping center. Blesener noted the Planner's recommendation that no food or liquor be served on site. Blesener stated that he would be opposed to any alcohol on site. Schifsky reported that they had no intention of requesting a liquor license. Scalze also pointed out that there are no liquor licenses available at this time. Fahey opened the public hearing on the Greg VanGuilder request to rezone 206 Little Canada Road from B -3 to RB and request for a variance for commercial lot size. Mr. VanGuilder reported that he has withdrawn his purchase agreement on the property and is withdrawing his rezoning and variance request. VanGuilder asked if he would be refunded the application fees he has submitted to the City. The City Clerk reported that after the Planner's fees and mailing and publication costs have been deducted, the balance of the fees would be refunded to VanGuilder. VanGuilder could expect to receive this refund on or about January 27. Mr. Collova introduced the following resolution and moved its adoption: RESOLUTION NO. 87 -12 -583 - CLOSING THE PUBLIC HEARING ON THE VANGUILDER REQUEST FOR REZONING AND COMMERCIAL LOT SIZE VARIANCE The foregoing resolution was duly seconded by Mrs. Scalze. Ayes (5) Collova, Scalze, LaValle, Fahey, Blesener. Nays (0). Resolution declared adopted. This resolution appears in Resolution Book No. 18, Page 632. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 87 -12 -584 - DENYING THE VANGUILDER REZONING AND VARIANCE REQUEST FOR 206 LITTLE CANADA ROAD BASED ON THE APPLICANT'S WITHDRAWAL OF THAT REQUEST Page 96 4
