Pat Harris <br />April 12, 2000 <br />Mr. Joel Hanson, Administrator <br />City of Little Canada <br />515 Little Canada Road <br />Little Canada, Minnesota 55117 <br />Re: NE Residence Respite Home property adjacent to Board of Water Commissioners <br />Vadnais Conduit R/W on Little Canada Rd. <br />Dear Mr. Hanson: <br />M their regularly- scheduled Board meeting last night, the Board of Water Commissioners generally <br />discussed whether it would ever be willing to sell a 6-foot wide strip of Board real estate at the <br />above - referenced location. The sale would be made based on a special and unique request of the <br />developer of the NE Residence Respite Home, who requires the parcel in order to comply with the <br />City of Little Canada's building setback requirements. <br />Based on the very unique circumstances and facts surrounding the developer's request, the Board <br />members that were present at the meeting expressed a general intent to sell the property as requested. <br />That intent, however, was conditioned on several very important conditions, including the following: <br />1. The Board shall impose a restrictive covenant over the parcel which prohibits any <br />person from using the property for any purpose other than to ensure compliance with <br />the City of Little Canada's setback requirements, and which forever prohibits the <br />construction, storage or maintenance of any building, structure, equipment or facilities <br />of any kind on the property. <br />13 The Board shall retain a perpetual and non - exclusive utility easement over, under, and <br />across the property, se that it may continue to use the property for its c tawnt purpose <br />and for any other future utility. <br />2. The Board shall receive fair market value for the parcel. <br />3. At its own expense, the developer shall provide all conveyance and transaction <br />documents necessary to complete the sale, including all legal documents and land <br />surveys, and any other documents the Board deems necessary, all subject to Board <br />approval. <br />SAINT PAUL REGIONAL WATER SERVICES <br />Bernie R.
