LEASE THIS LEASE, is made this day of , 2000, between Town & Country Center, LLC, a Minnesota limited liability company, (the "Lessor "), and Kathleen M DeLonais- Adams, (the "Lessee "). WHEREAS, on even date herewith, Dennis Evans, Kathleen M. DeLonais -Adams and Virgil Drusch, as co- trustees of that certain Revocable Trust under that certain Amendment and Restatement of Eugene M. DeLonais Revocable Trust Agreement effective September 19, 1997 (the "Trust ") conveyed fee title to that certain property legally described on Exhibit "A" attached hereto and made a part hereof (the "Property ") to the Lessor, and WHEREAS, Lessee occupied the Property prior to the above conveyance and would like to continue the occupy the Property until May 15, 2000, and WHEREAS, Lessor and Lessee enter into this Lease for the limited purpose of allowing the continued occupancy of the Property by Lessee until May 15, 2000. 263317v1 For valuable consideration, Lessor and Lessee agree as follows: 1. Lessor shall lease the Property to Lessee for a fixed term to expire on midnight, May 15, 2000. 2. Lessee shall pay rent to Lessor in the sum of Three Hundred Dollars ($300) per month during the term of this Lease. It is understood that this sum is roughly equivalent to One- Twelfth (1/12) of the anticipated real estate taxes due and payable on the Property in the calendar year 2000. Other than the payment of this amount to Lessor, Lessee shall have no other obligation to pay rent in connection with the Property or this Lease. 3. The term of this Lease shall expire automatically without notice to either party on May 15, 2000. Lessee shall vacate the Property and shall have the right to remove all personal property and fixtures from the Property on or before May 15, 2000. Simultaneously with the execution of this Lease by Lessee, Lessee shall execute and deliver to Lessor a Quit Claim Bill of Sale to be effective May 15, 2000 conveying any and all of Lessee's right, title and interest in and to any and all personal property and fixtures by that date which remain on the Property after May 15, 2000. If Lessee does not vacate the Property and remove all personal property and fixtures by May 1.5, 2000, Lessee forfeits any remaining right, title and interest to said personal property and fixtures and the same shall be deemed abandoned. 4. Lessor acknowledges the receipt of the sum of Six Hundred Dollars. ($600) Seven Hundred Fifty Dollars ($750) from Lessee on even date herewith, Page 119
