MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 10, 2000 <br />A property owner on the west side of Twin Lake Road requested <br />that the driveway for proposed Tract C not be located right on the <br />curve of the street, but closer to the northern property line for Tract <br />C. <br />The Planner pointed out that the ordinance requires that driveways <br />be located at least 40 feet from intersections. <br />Keis indicated that he saw no reason to require the improvement of <br />Mitchell Trail for this development. However, the issue of an <br />access road to the sanitary sewer was something that had to be <br />dealt with. <br />Preferred Builders questioned whether or not they would have to <br />pay for the access road. The Planner pointed out that the City <br />could require the dedication of the additional easement as well as <br />the installation of the access road as part of the subdivision. <br />Keis suggested that the property division be tabled at this time to <br />allow Preferred Builders to meet with the City to work out the <br />details of the access road. <br />The Deputy Clerk noted that dedication of an easement might be <br />preferable than dedication of public right -of -way as mentioned in <br />the Public Works Director's letter. Easement would limit the <br />access to the City's needs for maintaining utilities, while public <br />right -of -way would provide access to the general public. <br />Preferred Builders agreed that an easement was preferable to <br />dedication of right -of -way. Preferred Builders agreed that the <br />matter should be tabled so that he can discuss these issues with <br />both the City and the property owner. Preferred Builders noted <br />that there is a huge stand of pine trees on the property, and he was <br />concerned that installation of a gravel access road would cause the <br />removal of these trees. <br />The Public Works Director pointed out that the City already has a <br />15 -foot easement for the sanitary sewer line. He is asking that the <br />easement be widened to 25 feet and that a gravel access road be <br />installed. <br />Keis recommended tabling action on the property division for 3240 <br />Twin Lake Road as requested by Preferred Builders until the <br />Page 23 <br />
