City of Little Canada, Minnesota <br />Ordinance <br />AN ORDINANCE AMENDING SECTIONS 902 AND 903.030 OF THE LITTLE CANADA <br />CITY CODE, KNOWN AS THE ZONING ORDINANCE, BY PROVIDING FOR <br />ENCROACHMENTS INTO REQUIRED YARD SETBACKS FOR CERTAIN GRADE -LEVEL <br />IMPROVEMENTS. <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1. <br />Section 902.010.A.40. is hereby amended to read as follows: <br />40. Deck. A horizontal, unenclosed platform with or without <br />attached railing, seats, trellises, or other features, <br />attached or functionally related to a principal use or <br />site and at any point extending more than three (3) feet <br />six(6) inches above ground the immediately adjacent grade <br />at any point within two (2) feet of the structure. <br />Section 2. <br />Section 902.010.A.121. is hereby amended to read as follows: <br />121. Patio. A recreation area that adjoins or is related to <br />a dwelling at grade or principal structure, is no more <br />than six (6) inches above the immediately adjacent grade <br />at any point within two (2) feet of the patio, is often <br />paved with concrete, stone or masonry materials, and is <br />typically adapted especially to outdoor dining. <br />Section 3. <br />Section 903.030.C.2. is hereby amended to read as follows: <br />C.2. a. Terraces, steps, uncovered porches decks, stoops, <br />or similar features, provided they do not extend <br />above the height of the ground main entry level of <br />the principal structure or to a distance more than <br />five (5) feet into a required front yard or less <br />than five (5) feet from a side lot line. <br />2. Patios and sidewalks, provided they are used for <br />recreational purposes only, may encroach into the <br />required front, side, and rear yards. Where such <br />improvements encroach into an easement for drainage <br />or utility purposes, such improvement shall be <br />subject to the rights of the easement holder. <br />Page 30 <br />
