Hanson <br />Email: cityhall @ci.little - canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: February 4, 2000 <br />RE: Purchase of Schreier Property on Behalf of Precision Tree <br />Precision Tree has negotiated the purchase price with Dick Schreier for the triangular piece of <br />property on the south side of South Owasso Boulevard. The agreed upon price is $1.50 per <br />square foot of land. However, Mr. Schreier would like a Section 1033 letter (threat of eminent <br />domain) from the City as a condition of this sale. To do so, requires the City to enter into this <br />purchase agreement and then assign it to Precision Tree. <br />In discussing this matter with the City Attorney, an appraisal is not necessary given other land <br />costs we have paid in the Country Drive area indicates the $1.50 amount is reasonable. The City <br />Attorney did not see any objections to the transaction moving forward on the basis requested by <br />Mr. Schreier. However, there are still issues with the facility being constructed by Precision <br />Tree and its compliance with the I -P zoning requirements that must be addressed. <br />I have informed Precision Tree of our concerns in this regard. If the Council would like to assist <br />with this project, I would recommend we enter into a purchase agreement with Mr. Schreier that <br />would be contingent upon the following key components: <br />♦ The purchase agreement will be assigned to Precision Tree. <br />♦ The purchase agreement and assignment to Precision Tree will be subject to all required <br />zoning approvals for this site. An assignment document will need to be prepared <br />between the City and Precision Tree that documents their understanding that zoning <br />approvals are not guaranteed by the City. <br />♦ The closing date will need to be set at a point in time that will allow adequate time for the <br />zoning review to occur. <br />♦ Purchase price will be based on $1.50 per square foot as verified by a registered land <br />surveyor retained by the buyer. <br />Page 44 <br />
