Land Acquisition Costs, and <br />ii. those City Costs referred to in subsections (b) through (e) and the <br />last sentence of Section 3.6 hereof, <br />Reimbursable Land Acquisition and City Costs shall not exceed $205,000. <br />Reimbursable Land Acquisition and City Costs shall not include Site Improvement <br />Costs. <br />b. Reimbursable Soil Correction Costs means costs and expenses in excess of <br />$30,000 the Developer actually incurs and pays to correct adverse soil conditions <br />existing on the Development Property. Reimbursable Soil Correction Costs shall <br />not exceed $95,000. Reimbursable Soil Correction Costs shall not include costs <br />associated with the demolition and removal of presently existing improvements on <br />the Development Property. <br />5. Modification to Section 2.3(cl: The first sentence of Section 2.3(c) is deleted in <br />its entirety and replaced with the following: <br />The Developer shall submit to the City proposed Final Plans in form and <br />substance reasonably satisfactory to the City by no later than March 1, <br />2000." <br />6. Deletion of Section 2.3(d1: Section 2.3(d) is deleted in its entirety. <br />7. Modification of Section 2.3(e }: Section 2.3(e) is deleted in its entirety and <br />replaced with the following: <br />(e) The Developer shall prepare all necessary plats, surveys and other <br />subdivision requirements and apply for all rezoning, subdivision and <br />architectural review approvals by no later than December 27, 1999. <br />8. Modification of Section 2.3(0: Section 2.3(1) is deleted in its entirety and <br />replaced with the following: <br />(f) The Developer ehall perform and pay all coats of demolition and <br />debris removal and geotechnical work and/or soil corrections and all <br />environmental investigation and rentediation, if any, on the Development <br />U22867.3 2 <br />
