MINUTES <br />CITY COUNCIL <br />NOVEMBER 10, 1999 <br />Scalze reported that it is necessary to know where the property line is to <br />determine whether parking has been appropriately placed. <br />Mr. Rossow indicated that he is not sure of the location of his property <br />line. He assumed it was at the edge of the curb, but has learned that is not <br />the case. <br />The City Administrator suggested that plans from the 1991 street <br />improvements in Ryan Industrial Park could be reviewed to determine <br />where the street surface lies in relation to the right -of -way. Once that is <br />know, a measurement can be taken from the center of the blacktop to <br />determine property line location. <br />Morelan felt it was one thing to have the landscape structures in the right - <br />of -way, but it was not acceptable to allow Mr. Rossow to locate his <br />parking in the right -of -way. <br />The Zoning Administrator indicated that she would check the street <br />improvement plans to try and determine property line location. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 99 -11 -227— TABLING ACTION ON THE <br />APPLICATION FOR CONDITIONAL USE PERMIT FOR OPEN <br />AND OUTDOOR STORAGE OF MATERIALS AND EQUIPMENT AS <br />AN ACCESSORY USE FOR 3101 SPRUCE STREET PENDING <br />FURTHER REVIEW OF THE PROPERTY LINE LOCATION ISSUE <br />BY CITY STAFF <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Morelan, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />Morelan asked the reaction of the Public Works Director to the issue of <br />the landscape structures within the right -of -way. The Public Works <br />Director indicated that he met on the site with Mr. Rossow and the Zoning <br />Administrator. As part of that meeting, the issue of access to the fire <br />hydrant was resolved in that Mr. Rossow agreed to level the area around <br />the hydrant and make a four -foot access area around the hydrant. He also <br />agreed to install to bollards behind the hydrant to protect it from vehicles <br />coming in and out of the property. The Director reported that his other <br />concern was that the structures were too close to the road surface, thus did <br />not provide adequate room for snow storage.
