Hanson <br />www. ci.little- canada.mn. us <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: July 6, 2012 <br />RE: Abatement Agreement <br />A fire hazard exists at 135 Viking Drive (Oakmont Condominiums) — Unit #302 (see June 8th <br />letter from Fire Marshal). The property owner has been given time to attempt corrections of the <br />violations with little success. To that end, staff prepared the attached "Agreement" that covers <br />abatement of the violations using contracted work. The property owner and tenant have <br />executed the agreement and are agreeing to allow our representatives access to the site. The <br />property owner is also aware that the charges incurred plus an administrative fee of 15% will be <br />certified for collection over five years starting with the 2013 property taxes. This document was <br />modeled after one used a couple of years ago in a similar situation. <br />The Fire Marshal has also obtained quotes for clean -up work. The costs quoted are as follows: <br />• 18000otJunk — 3 cubic yard truck - $498 per load (30 yds = $4,980) <br />• Kaldecon Services, Inc. — 10 yard dumpster - $2,000 <br />— 20 yard dumpster - $3,000 <br />— 30 yard dumpster - $4,500 <br />• Flo Magadan - $55 per hour for him and $67 if he adds a helper <br />Dumpster, recycling, disposal — are extra costs. <br />Staff estimates that it will take two people 40 hours each for a total cost of <br />$2,680. Rental of a 30 yard dumpster with disposal will run about $435 <br />bringing the estimated cost to $3,115. (To equal the next lowest price of <br />$4,500, we could have an additional 20 hours of a two - person crew.) <br />Family members of the owner and tenant may get involved to help rectify the situation. The Fire <br />Marshal will inspect the property next Wednesday. Staff is recommending approval of the <br />Abatement Agreement as presented and award of the clean -up work to Flo Magadan based <br />on our past experience with him and our estimate that the total charges will be less for his <br />services than our other options. If next Wednesday's inspection reveals significant <br />progress, we will hold enforcement of the agreement in abeyance for one week to allow <br />completion. If progress is lacking, we will commence abatement ASAP. <br />1 <br />
