(6) The collector(s) shall perform their work in a neat and quiet <br />manner and clean up all refuse, yard waste or recyclables spilled <br />in collection under any circumstance. <br />(7) <br />All containers shall be replaced on the boulevard adjoining the <br />curb. <br />(8) Damage to containers or other property shall be avoided. <br />(9) Gratuities shall not be accepted. <br />(10) Consumption of any beverages containing alcohol or controlled <br />substances shall be forbidden during or before work hours of <br />any collection day. <br />(11) Before the start of each collection day, the collection crew shall <br />check to see that the collection vehicle is equipped with at least <br />one broom and shovel for use in cleaning up refuse, yard waste, <br />or recyclables spilled during collection or hauling. <br />3. Liquidated Damages. <br />The Contractor agrees, in addition to any other remedies available to the City, the <br />City may fine the Contractor in the amounts specified below as liquidated <br />damages for failure of the Contractor to fulfill its obligations. The City will <br />notify the Contractor in writing documenting the nature of the violation, the <br />history of the account, if any, and the reason for the fine. The Contractor shall <br />then have the opportunity to address and remedy the issue at which point the City <br />shall determine if a fine is still appropriate, in their sole determination. The <br />Contractor shall notify City in writing of its remedy. <br />a. Failure to clean up solid waste spilled by Contractor within six (6) hours <br />of oral or written notification - $50.00 each instance. <br />b. Failure to maintain vehicle in a manner, which prevents nuisances such <br />as leaky seals or hydraulics - $100.00 each instance. <br />c. Failure or neglect to collect solid waste, recycling, (or yard waste /bulky <br />goods if part of the proposal) at those times provided by the Agreement <br />within 24 -hours after either oral or written notice by City - $50.00 each <br />instance. <br />d. Failure or neglect to provide notice to resident upon solid waste or <br />recyclables refused for collection for cause - $25.00 each instance. <br />-14- <br />15 <br />
