Hanson <br />www.ci.little-canada.mn.us <br />July 16, 2012 <br />Sam Leon <br />2021 Broadway Street, North <br />Stillwater, MN 55082 <br />RE: NOTICE OF VIOLATION & ABATEMENT - 3006 Rice Street in Little Canada <br />To Whom It May Concern: <br />The City of Little Canada has received several complaints regarding lack of maintenance of the <br />property you own at 3006 Rice Street. Based on an inspection of the property, the following <br />violations are present (see photos attached): <br />• Accumulation of rubbish (cans, brush, and other debris are located in the dumpster screening <br />area and need to be removed from the property and legally disposed of) — Municipal Code <br />601.030(e) <br />• Grass not maintained in appropriate manner plus excessive weeds present on the property — <br />Municipal Code 601.030(h) <br />• A damaged awning being stored under the drive -up canopy — Municipal Code 601.030(M) <br />• Refuse container not located in designated screening area to prevent visibility from residential <br />Areas — Zoning Code — 903.020.F.8.d. <br />If corrections are not completed by Wednesday, July 25, 2012 the City will take the necessary steps <br />to abate the nuisance pursuant to Section 601.080 of the Little Canada City Code. (Text Below) This <br />process will include staff's request of the City Council to authorize the abatement of these nuisance <br />violations at their meeting of July 25, 2012. If so ordered, all costs of the abatement together with a <br />fee in the amount of not more than 25% of the cost to abate the nuisance shall be imposed for <br />collection with 2013 property taxes. In no event shall the administrative fee be less than $50.00. <br />Two other additional violations also need your attention. The first involves potholes in the <br />drive /parking area. This is a violation of Zoning Code 903.050.E. The second relates to the <br />existence of the A &W sign on the property. 903.110.D.2 states, "Any sign identifying a business no <br />longer in existence shall be brought into conformance with thirty (30) days." This means the sign <br />needs to be removed from the property. If the nuisance items previously noted are corrected by July <br />25th, we will allow you additional time (up to Augusts 15t1i) to make these two corrections. <br />7 <br />
